Terms & Conditions for Paid Research Studies

These Terms & Conditions ("Terms") govern participation in paid research studies — including paid surveys and paid interviews — organized by Survicate S.A. with its registered office in Warsaw (postal code 02-786) at ul. Zamiany 8 LU2, entered into the register of entrepreneurs of the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register under KRS number: 0001021023, NIP number: 9512390641 ("Survicate", "We", "Our" or "Us").

By registering interest in, or taking part in, any Research Study, you ("Participant", "You") confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

1. Definitions

1.1. Research Study – any research activity organized by Survicate for product development, user experience, or market research purposes, including but not limited to online surveys, one-on-one interviews, group interviews, usability tests, and prototype feedback sessions.

1.2. Paid Survey – a Research Study conducted in the form of a online survey for which an Incentive is offered.

1.3. Paid Interview – a Research Study conducted in the form of a live conversation (via video call) between the Participant and Survicate's researchers, for which an Incentive is offered.

1.4. Incentive – the reward offered by Survicate for complete and valid participation in a given Research Study, as specified in the invitation or study description (digital gift card)

1.5. Invitation – the communication (e.g., email, in-product message, social media post, or landing page) through which Survicate invites potential Participants to a specific Research Study, including study-specific details such as topic, estimated duration, eligibility criteria, and the Incentive.

2. Eligibility

2.1. Participation in Research Studies is open to natural persons who are at least 18 years old and have full legal capacity.

2.2. Specific Research Studies may have additional eligibility criteria (e.g., professional role, use of specific tools, company size, or geographic location) described in the Invitation or verified through a screening questionnaire.

2.3. Survicate employees, contractors, and their immediate family members are not eligible to receive Incentives, unless the Invitation explicitly states otherwise.

2.4. You may be asked to confirm your eligibility before or during a Research Study. Providing false or misleading information in a screening questionnaire or during a Research Study disqualifies you from receiving the Incentive.

3. How participation works

3.1. Participation in any Research Study is entirely voluntary. You may withdraw at any time without giving a reason; however, withdrawal before completing the Research Study may mean you are not entitled to the Incentive (see Section 4).

3.2. Responding to an Invitation or completing a screening questionnaire does not guarantee selection for a Research Study. Survicate selects Participants at its sole discretion, based on the research needs of a given study.

3.3. For Paid Interviews, you will be asked to book a time slot. If you need to reschedule or cancel, please do so at least [24] hours in advance using the link in your booking confirmation or by contacting us at support@survicate.com. If you fail to attend a scheduled interview without prior notice ("no-show"), you will not be entitled to the Incentive, and We may exclude you from future Research Studies.

3.4. Survicate reserves the right to cancel, reschedule, or modify any Research Study at any time. If a Paid Interview is cancelled by Survicate less than [24] hours before the scheduled time, We may — at Our discretion — offer you an alternative time slot or a partial or full Incentive.

3.5. By participating in a Research Study, you agree that Survicate may contact you by email or phone to: (a) follow up on your responses and ask clarifying questions, (b) invite you to further interviews or Research Studies, and (c) send you marketing communication about Survicate's products and services. You may withdraw this consent at any time, free of charge, by clicking the unsubscribe link in any of Our emails or by contacting us at support@survicate.com. Withdrawing consent does not affect your right to any Incentive already earned.

4. Incentives

4.1. The type and value of the Incentive for a given Research Study are specified in the Invitation. Incentives are always delivered electronically, via email, to the email address you provide. Make sure your email address is correct and check your spam folder if you cannot find the Incentive message.

4.2. To be entitled to an Incentive, you must: (a) meet the eligibility criteria for the given Research Study, (b) complete the Research Study in full and in good faith (e.g., attend the entire interview or submit a complete survey), and (c) provide accurate contact details for Incentive delivery.

4.3. Incentives are usually delivered within 5 days of completing the Research Study. If you have not received your Incentive within this period, contact us at support@survicate.com.

4.4. Incentives are non-transferable and cannot be exchanged for cash unless applicable law requires otherwise or the Invitation states otherwise. One Incentive is granted per Participant per Research Study, regardless of the number of devices, email addresses, or accounts used.

4.5. Survicate reserves the right to withhold or reclaim an Incentive where there are reasonable grounds to believe the Participant: (a) provided false information, (b) participated more than once in the same Research Study using different identities, (c) used bots, scripts, or other automated means, (d) submitted responses that are incomplete, unintelligible, or given without genuine engagement (e.g., random or patterned answers), or (e) otherwise breached these Terms.

4.6. You are solely responsible for any tax obligations arising from receiving an Incentive under the laws applicable to you. Survicate does not provide tax advice. Where required by applicable law, Survicate may request additional information from you for tax reporting purposes.

4.7. Participation in a Research Study does not create an employment relationship, contract of mandate, agency, or partnership between you and Survicate. The Incentive is a voluntary reward for participation, not remuneration for work or services.

5. Recordings and research materials

5.1. Paid Interviews may be recorded (audio, video, and/or screen sharing) and transcribed for research purposes. You will always be informed before recording starts, and recording will only take place with your consent. If you do not consent to being recorded, you may still be able to participate — the researcher will take written notes instead — unless recording is essential to the given study, in which case We will inform you in the Invitation.

5.2. Recordings, transcripts, notes, and survey responses ("Research Materials") are used solely for internal purposes: improving Survicate's products and services, understanding user needs, and informing product, marketing, and business decisions.

5.3. Survicate will not publish your recordings, or quote you in external materials in a way that identifies you, without your separate, explicit consent.

5.4. By participating in a Research Study, you grant Survicate a non-exclusive, worldwide, royalty-free license to use the feedback, opinions, ideas, and suggestions you share during the Research Study, including for the purpose of developing and improving Survicate's products and services, without any obligation to compensate you beyond the Incentive. This does not transfer ownership of any of your pre-existing intellectual property.

6. Personal data

6.1. Survicate S.A. is the controller of personal data processed in connection with Research Studies. The rules for processing personal data are set out in our Privacy Policy, which describes the legal bases for processing, retention periods, and your rights as a data subject under the GDPR.

6.2. Personal data processed in connection with Research Studies typically includes: your name, email address, professional information provided during screening (e.g., role, company size, tools used), your survey responses or interview content, and — where you have consented — recordings and transcripts.

6.3. Your personal data is processed for the purposes of: organizing and conducting Research Studies (performance of an agreement — Art. 6(1)(b) GDPR), delivering Incentives and fulfilling related legal obligations (Art. 6(1)(c) GDPR), and analyzing research results to improve Our products and services (legitimate interest — Art. 6(1)(f) GDPR). Recordings and marketing communication are processed on the basis of your consent (Art. 6(1)(a) GDPR), which you may withdraw at any time.

6.4. You have the right to access, rectify, erase, or restrict processing of your personal data, the right to data portability, the right to object, and the right to lodge a complaint with a supervisory authority (in Poland: the President of the Personal Data Protection Office, UODO). 6.5. Research Materials are stored only for as long as necessary for the research purposes described above, in accordance with our Privacy Policy.

7. Confidentiality

7.1. During a Research Study, you may be shown unreleased features, prototypes, designs, roadmaps, or other non-public information about Survicate's products and business ("Confidential Information").

7.2. You agree not to disclose, share, publish, or otherwise make available any Confidential Information to any third party, including on social media, without Survicate's prior written consent. This obligation continues after the Research Study ends.

7.3. For selected Research Studies, We may ask you to sign a separate non-disclosure agreement before participating.

8. Participant conduct

8.1. You agree to participate in Research Studies honestly and in good faith, to treat Survicate's researchers with respect, and not to engage in any abusive, offensive, or unlawful behavior.

8.2. You may not record Paid Interviews yourself or take screenshots of materials shown to you during a Research Study without Survicate's prior written consent.

8.3. Survicate reserves the right to end a Research Study session early and/or exclude a Participant from current and future Research Studies in the event of a breach of these Terms.

9. Liability

9.1. To the fullest extent permitted by law, Survicate shall not be liable for: (a) technical issues on the Participant's side that prevent participation (e.g., internet connection, hardware, or software failures), (b) the unavailability of a specific Incentive type, in which case Survicate will offer an Incentive of equivalent value, or (c) delays in Incentive delivery caused by third-party providers or by incorrect contact details provided by the Participant.

9.2. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights.

10. Complaints

10.1. Complaints regarding Research Studies or Incentives can be submitted electronically to support@survicate.com within 30 days of the event giving rise to the complaint.

10.2. A complaint should include: your name, the email address used to participate, the name or date of the Research Study, and a description of the issue.

10.3. We will respond to complaints as soon as possible, and no later than within 14 days of receipt.

11. Changes to these Terms

11.1. Survicate reserves the right to amend these Terms. The current version will always be available at [https://survicate.com/paid-research-terms/ — confirm final URL].

11.2. Changes do not affect Research Studies completed before the changes came into force. For ongoing Research Studies, Participants will be informed of substantial changes by email.

12. Governing law and jurisdiction

12.1. These Terms are governed by and construed in accordance with the laws of Poland, without prejudice to mandatory consumer protection provisions of the country of your habitual residence.

12.2. Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent Polish courts, unless mandatory law provides otherwise. Consumers may also use out-of-court dispute resolution mechanisms, including the EU Online Dispute Resolution platform available at https://ec.europa.eu/consumers/odr.
